Terms and Conditions

1) Each Competition (the "Competition") is organised by or on behalf of UTV Interactive Limited, Teddington Studios, Broom Road, Teddington, TW11 9NT (UTVi).

2) UTVi reserves the right to amend these Terms and Conditions at any time without notice and by entering the Competition you agree to be bound by the Terms and Conditions in force at the time of entry. You are therefore advised to check the current Terms and Conditions prior to entry to each Competition.

3) The Terms and Conditions in force from time to time will be posted on this website. Any instructions for entry given by UTVi during any broadcast, displayed on the Brain Box website, or during any telephone call, relating to entry and participation in the Competition shall also form part of these Terms and Conditions.

Competition Entry

4) Except as further set out in these Terms and Conditions the Competition is open to Northern Ireland, Scotland and Republic of Ireland residents aged 18 years or older and by entering the Competition you warrant that you are a Northern Ireland, Scotland or Republic of Ireland resident, aged 18 years or older, and are not within any of the classes of persons listed in paragraph 5 below. You acknowledge that UTVi will be entitled to withhold any prize if you misrepresent in any way your eligibility to enter the Competition.

5) The following persons may not enter the Competition or win a prize:
a) employees of UTVi; employees of UTV Media plc or any associated company;
b) employees of PIMS-SCA Limited or SCA Promotions or Netplay TV plc or STV or their associated or companies
c) employees of suppliers or subcontractors of UTVi
d) in relation to any of the people listed above, their immediate families and/or household members. For these purposes, immediate family includes partner, grandchild, child, brother, step-brother, sister, step-sister, parent, step-parent, or grandparent of you or your partner or anyone noted as next of kin on any legal document

6) UTVi will have sole and absolute discretion as to whether to accept you as an entrant. UTVi reserves the right to exclude you permanently from the Competition in its sole discretion.

7) To enter the Competition you may either:
a) telephone the relevant Premium Rate Telephone Number advertised; or
b) enter via the website at http://www.brainboxquiz.tv You will be issued with a PIN (personal identification number) and an access telephone number (standard rate call charges apply) to call and enter the Competition (standard rate call charges apply).

8) If entering via the premium-rate number in Northern Ireland or Scotland, your call will cost no more than £1.54 using BT's network. In the Republic of Ireland, a call to the premium-rate number costs €1.50 including VAT from an Eircom landline. Calls from other networks and public phone boxes may vary, mobiles will cost considerably more. UTVi takes no responsibility for any such variance in charges. Calls are capped at 50 per day and 300 per month per person. Any attempted entries above these limits will be null and void.

9) If you are entering the Competition by telephone and are not the bill payer, you must get permission from the bill payer before calling

10) The Premium Rate Telephone Numbers are operated by a third party. Neither UTVi nor the third party shall be liable to reimburse any expenses incurred by you or any entrant in calling the Premium Rate Telephone Number.

11) Once the telephone number has been dialled and the call is connected you will be charged regardless of whether or not you are selected to be put through to the studio where BrainBox ("The Quiz") is being presented.

12) On calling the Premium Rate Telephone Number your call will pass through a random selection mechanism. A recorded message will notify you of the result of the random selection. You will either:
a) be put on hold for an opportunity to be put through to the studio; or
b) be notified that your entry has not been short-listed. If your entry is not short-listed you will still be charged for the call.

13) In the event that UTVi undertakes to submit Competition entries into a second Competition without requiring you to make an additional entry, UTVi will make all reasonable endeavours to ensure that your entries for the stated period are entered into that Competition. UTVi accepts no responsibility for Competition entries that are not entered into a second Competition howsoever caused. UTVi may not be able to submit your Competition entry into a second Competition if your Network Provider withheld your telephone number when you called. Therefore if you wish to ensure that all your calls can be entered into a second Competition please contact your Network Provider. Customers selected at random to win a prize in such a second Competition may be called back during the broadcast of Brain Box.

14) The date and time of each selection draw for the second competition will be broadcast in advance. If, after 28 days, contact could not be established with the qualifying person, UTVi reserves the right to continue to draw further entries until either the prize is won or, at its sole discretion, it decides to end the draw.

15) UTVi may from time to time offer Promotional Entries to selected entrants. Such entries will be awarded to entrants as determined by UTVi in its sole discretion. A Promotional Entry is entered into the same random selection process as other entry routes. If you have been awarded a Promotional Entry you will be notified in advance and instructions will be given to you on how to redeem the Promotional Entry.

16) UTVi reserves the right to pay prizes to the entrant only and to request proof of identity and eligibility, including an itemised telephone bill, before payment can be made.

17) Calls may be recorded for security and/or training purposes.

18) To enter via the website, you will need to submit your details on the web entry form provided at http://www.brainboxquiz.tv Subject to paragraph 6 above, you will be issued with a PIN (personal identification number) and an access telephone number to call and enter the Competition. Each entry made on the website will generate exactly one PIN which can be used for one call to the access telephone number. The PIN can be retrieved up to 3 days before the quiz you want to participate in. The PIN is only valid for competitions running on the day selected on the website. An unused PIN expires at the end of that day's Quiz. A maximum of 50 PIN entries per Quiz and 300 entries per person per month can be made. Any attempted entries above this will be null and void. UTVi will undertake all reasonable endeavours to make the website available at all times, however UTVi does not take any responsibility if the website is not available at a particular time.

19) UTVi accepts no responsibility where any call back is not connected to your phone or is delayed, howsoever caused.

20) Prizes will be awarded in Euro to entrants from the Republic of Ireland, and in Pounds Sterling to entrants from Northern Ireland and Scotland. Prizes will be awarded in the form of a cheque and these will be sent out within 28 days from the date of the Competition. UTVi will not be liable for any failure to dispatch the prize cheque to the winner within this time, nor any failure of the recipient to cash the cheque within six months of the date of the cheque. Prize cheques will only be payable to the name of the entrant. Prizes not claimed within six months of the date of the relevant Competition will be forfeited.

21) Notwithstanding the limits referred to in paragraphs 8 and 18 UTVi recommends you set yourself a limit and stick to it. UTVi operates a Fair Entry Policy and may exclude entrants from entering future Competitions where it believes an entrants actions contravene such policy. UTVi's decision in such matters is final, will be communicated to the entrant prior to implementation, and no correspondence or review process will be entered into.

22) UTVi may withdraw or cancel any Competition for any reason and at any time and may change the prize to a prize of similar value without notice.

23) You will be responsible for paying any and all taxes on any prize you win.

24) The name and home county of the winner may be published by UTVi on this website. UTVi may exercise its sole discretion to use any winner's name, address, and image and their comments relating to the prize and competition experience for future promotional, marketing and publicity purposes in any media worldwide without notice or without any fee being paid.

25) If a competition is continued beyond the broadcast of Brain Box on STV without the relevant answers being revealed, these will be published on the following working day at www.stv.tv/win.

Limitation of Liability

26) UTVi, their distributors, its suppliers, their group companies and sub-contractors do not accept any responsibility whatsoever for (i) any technical failure or malfunction or any other problem in any telephone network or line, system, server, provider or otherwise which may result in any message being lost or not properly recorded, or (ii) traffic congestion or other capacity issues which may result in a message not being able to get through or a message not being recorded.

27) To the fullest extent permitted by law, UTVi hereby excludes all warranties, representations, covenants and liability (whether express or implied) regarding the Competition or any prize. The Competition is provided on an "as is" and "as available" basis. Nothing however shall exclude UTVi's liability for death or personal injury as a result of its negligence.

28) UTVi is not liable in contract, tort (including, but not limited to negligence) or otherwise in connection with the Competition for loss of revenues, contracts, profits, business, savings or any special, indirect or consequential losses or any loss of goodwill or reputation.

29) UTVi will not be liable for any damages or losses whether direct or indirect that you may suffer as a result of a failure by UTVi to deliver the Competition.

Privacy, Disputes, and Applicability of these Terms and Conditions

30) Any personal data collected by or on behalf of UTVi will be used in accordance with current UK data protection legislation, save that by entering the Competition, you consent to use of this data as set out in the privacy policy. Please see UTVi's privacy policy for further details.

31) In the event of any dispute regarding the Competition, the decision of UTVi shall be final and binding and no correspondence or discussion shall be entered into with you or any person acting on your behalf.

32) UTVi may disqualify you from winning the prize if it has reasonable grounds to suspect you may be in breach of these Terms and Conditions and/or your participation in the Competition may be fraudulent or otherwise unlawful (including but not limited to the use of technology or software which enables you to evade charges when entering the Competition by the Premium Rate Telephone Number or to make excessive numbers of entries via the website). UTVi may request you to provide proof of your eligibility to enter the Competition or your compliance with these Terms and Conditions before being entitled to a prize.

33) These Terms and Conditions shall be governed by Northern Ireland law and shall be subject to the exclusive jurisdiction of the Northern Ireland courts.
